Azimuth Stormglass™ Terms of Use

Version 2026-10-22 · effective October 22, 2026

These Terms are a binding agreement. You accept them by checking the box on the login page and logging in. If you do not agree, do not log in. If you accept for a company, you confirm you have authority to bind it, and "you" means you and that company.

1. Who we are

Azimuth Stormglass (the "Service") is provided by Azimuth Risk Group, LLC ("Azimuth", "we", "us"), a Disaster Preparedness™ service and a disabled veteran-owned business. The Service includes the website at azimuth-stormglass.com, the logged-in application, its software, data processing, methods, designs, reports and every update.

2. Your account

  1. Each login is for one named person. You will not share your login, your login codes or your session with anyone, inside or outside your company.
  2. You are responsible for everything done under your login. Tell us at once at ron@azimuthriskgroup.com if you believe your login was used by someone else.
  3. We may suspend or end any login at any time to protect the Service, our property or other customers.

3. Your licence

While your company's subscription is active, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable and revocable licence to use the features of your plan for your company's own internal business, for the properties in your company's own book. Everything not expressly granted is reserved to Azimuth.

4. What you agree not to do

The Service, its interface, workflows, methods, calculations, layouts, report designs and code are Azimuth's property and confidential. You agree that you will not, and will not help or allow anyone to:

  1. copy, reproduce, record or capture the Service, including by screenshot, screen recording, photograph or any other means, for the purpose of copying, studying to replicate, publishing or sharing the Service itself, its interface, workflows or methods;
  2. reverse engineer, decompile, disassemble, inspect, extract or copy the Service's code, data structures or methods, including through browser developer tools, "view source", saved web pages or network captures;
  3. scrape, harvest, crawl or bulk-download the Service or its data by any automated means, or download more than the Service's own download buttons provide;
  4. build, design, train or assist in building any product, service, model or tool that copies or competes with the Service, or use the Service or its outputs to train or improve any artificial-intelligence or machine-learning system;
  5. give, sell, rent, lend or show access to the Service to anyone who is not an authorised user of your company, or use another customer's access;
  6. get around, test or defeat any login, security, plan limit, watermark or technical measure, or use features your plan does not include;
  7. remove or alter any copyright, trademark, source or confidentiality notice, including those on reports; or
  8. use the Service in breach of any law, including the laws on contacting property owners described in section 8.

5. What you may do with your reports

The Service exists to produce records you can use. You may print, save and share the Storm Reports, property lists and spreadsheets the Service produces for properties in your own book with your own clients, boards, owners, insurers, adjusters, attorneys and contractors in the ordinary course of your business, provided you do not alter them in a way that misstates their contents and you keep their notices and sources intact. Sharing a report is not sharing the Service; section 4 still applies to the Service itself.

6. Ownership

  1. Azimuth and its affiliates own the Service and all intellectual property in it, including Azimuth Stormglass™, Disaster Preparedness™ and every other Azimuth name and mark, and every improvement, whether or not suggested by you. Any suggestion you make may be used by us freely.
  2. Your company owns the property data it uploads. You give us the right to host, copy, process and display it to provide the Service to you, and to keep it secure.

7. Confidentiality

Everything about the Service that is not published on our public website, including the logged-in interface, workflows, methods, features, pricing and plan terms, is Azimuth's confidential information. You will keep it confidential, use it only to use the Service, and protect it with at least the care you use for your own confidential information, and never less than reasonable care. This duty survives the end of your access.

8. Public data, no professional advice, and your use

  1. The Service reads public and third-party sources, including NOAA, the National Weather Service, the Iowa Environmental Mesonet, USGS, FEMA, Google, Esri, OpenStreetMap and county records. Those sources can be incomplete, delayed, revised or wrong. NOAA, for example, posts some radar records a day or more after a storm. We do not control them and do not guarantee them.
  2. Reports describe the weather and building record near a property. They are not an inspection, engineering opinion, legal advice, insurance or adjusting advice, or a finding that any property was or was not damaged. You are responsible for every decision you make with them and for having qualified people inspect a property.
  3. If you use the Service to contact property owners, you alone are responsible for complying with every law that applies, including the Telephone Consumer Protection Act, do-not-call rules, email laws, and each state's rules for public adjusters, contractors and solicitation after a disaster.

9. Disclaimer

The Service, its data and its reports are provided "as is" and "as available". To the fullest extent the law allows, Azimuth disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, accuracy, non-infringement and uninterrupted or error-free operation.

10. Limit of liability

To the fullest extent the law allows, Azimuth and its owners, officers, employees, affiliates and suppliers will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, revenue, claims, data or goodwill, however caused, and Azimuth's total liability for all claims relating to the Service will not exceed the fees your company paid Azimuth for the Service in the twelve months before the claim arose.

11. You carry the risk of your use

You and your company will defend, indemnify and hold harmless Azimuth and its owners, officers, employees, affiliates and suppliers from and against every claim, demand, loss, liability, penalty, fine, cost and expense, including reasonable attorneys' fees, arising out of or relating to: your or your company's use of the Service or its reports; any decision made or action taken in reliance on them; any data you upload; any contact you make with property owners or others; your breach of these Terms; or your violation of any law or of anyone's rights. We may take part in the defence with our own counsel at our own cost.

12. How we protect our property

  1. A breach of sections 2, 4 or 7 will cause Azimuth irreparable harm that money alone cannot repair. Azimuth is entitled to an injunction and other equitable relief to stop or prevent any such breach, without having to prove actual damages and, to the extent the law allows, without posting a bond, in addition to every other remedy available, including damages.
  2. In any action to enforce these Terms in which Azimuth prevails, you will pay Azimuth's reasonable attorneys' fees, expert fees and costs.
  3. We log use of the Service, including logins, pages and actions, and reports and screens may carry identifying marks, so that misuse can be traced. You consent to this.
  4. We may suspend or end your access at once, without notice or refund, if we believe you have breached these Terms.

13. Plans, fees and changes

Fees, plan features and billing terms are as agreed in writing with your company. We may add, change or remove features. If we change these Terms, we will post the new version with a new date and ask you to accept it at your next login; you may not continue using the Service without accepting it.

14. When access ends

When your access ends you will stop using the Service. On written request within 30 days, we will export your company's uploaded property data to you, and then delete it within a reasonable time, except where the law or a dispute requires us to keep it. Sections 4 to 12 and 15 survive.

15. Law and courts

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-laws rules. The state and federal courts located in Travis County, Texas have exclusive jurisdiction over any dispute relating to the Service or these Terms, and you consent to their jurisdiction, except that Azimuth may seek an injunction in any court with jurisdiction.

16. General

These Terms, together with any written agreement with your company and our Privacy Policy, are the whole agreement about the Service. If a provision is unenforceable, it will be enforced to the extent possible and the rest remains in force. You may not assign these Terms; we may assign them with our business. Our not enforcing a provision is not a waiver. Notices to us go to ron@azimuthriskgroup.com.
